4. CITIZEN'S INPUT:
Don Leget, 307 5th Street, said he has had a tree in his front yard that belongs to the City that had an 8 foot crack when he moved in, it is now a 12 foot crack. He has asked the Public Works Department to have it removed, but that hasn't occurred yet. He would like to see that taken care of.
Jon Winkel said that we will work on that.

7.DISCUSSION/ACTION ITEMS:
7.aPROCLAMATION: Fire Prevention Week (Oct 5-11)
Jon Winkel proclaimed October 5th through the 11th as Fire Prevention Week.
7.bCouncil Approval of Final Acceptance of the South Lewis Blvd Storm Crossing Project and Authorize Final Payment to SubSurfCo in the Amount of $17,566.57
Motion by Andrea Johnson, seconded by Kirk Moriarty to Approve the Final Acceptance of the South Lewis Blvd Storm Crossing Project and Authorize the Final Payment to SubSurfCo in the amount of $17,566.57.
Motion Carried. [Unanimous]
7.cDiscussion and Potential Direction regarding hosting a Carnival for the 2026 Pioneer Valley Days
Danny Christoffers explained that the carnival was brought to Sergeant Bluff this year for Pioneer Valley Days. He worked with the City's insurance company in September 2024 to ensure that we could get additional insurance, however it was later discovered that all the policies had an exclusion for mechanical rides. The City did receive the Certificate of Liability Insurance from the carnival company which listed the City as the "additional insured". He described a variety of different solutions he's explored to obtain additional insurance; he continues to explore options. Other cities/entities take on the liability themselves or a third party runs the event.
The Mayor and Council discussed with the City Attorney the ways a contract could be written to provide some indemnification to the City, the possibility of finding a non-profit or sponsoring third party to run the carnival, legal and liability issues pertaining to the carnival, the mostly positive reception from the community regarding having the carnival, and the goal to have more rides for teens/adults in the future.
Motion by Kirk Moriarty, seconded by Ron Hanson to direct City staff to negotiate bringing the Carnival back to Sergeant Bluff for 2026 and for the City Attorney to prepare an agreement between the City and the Carnival company that indemnifies the City at an appropriate level or the City will pursue finding a sponsor or third party to handle the carnival.
Motion Carried. [Unanimous]
8. ADMINISTRATOR'S REPORT:
Aaron Lincoln said that the Woodbury County Solid Waste Agency had not previously met for three years, he was able to attend the most recent meeting. He was selected as Vice-Chair, the Chair is the Mayor of Moville. The cities annual rental amount will be reduced by 25% next budget year due to the cash-on-hand in the organization being in a good place. The high school cross country team had it's first ever home meet. The school was happy with the how the event went. Our Police Department was present helping to secure Warrior Road. On October 1st there will be a pre-construction meeting for the water line along S Lewis Blvd/220th. That project will begin on approximately October 15th. On October 6th the Safe Routes to School meeting will take place. Jan Harmon has turned in an application for Phase 2 of the Baker Prairie Bluff PUD (Planned Unit Development).
Jon Winkel said that he had a good discussion with Jan Harmon today, he wanted to thank her for helping get Kwik Star here.
9. COUNCIL MEMBER'S REPORTS & COMMENTS:
Kirk Moriarty said that he has received complaints about the rough conditions of Airview Drive with the traffic that the street gets, he hopes we can look into that. He also encountered a kid on an electric scooter that was going fast enough that the scooter was showing instability. He is glad to see the community supporting Kwik Star after their opening. He noticed the nice way the Police Department is interacting with the kids in the community through various activities.
Mark Reinders also appreciated the way the Police Department interacts with the community. He promoted the 25on25 volunteer litter cleanup event, that will occur on Thursday the 25th at 10am, if anyone wants to sign up to participate in that regular event they can e-mail dan@cityofsergeantbluff.com.
Andrea Johnson said that Kwik Star opening was great and well attended, she hopes people keep going there. The Big Bash event is on October 11th, there will be a mechanical bull, please get your tickets if you want to attend. She mentioned that long ago there was a push for everyone in Old Town to get sidewalks, but there is not a sidewalk on the west side of Front Street and she was hoping to determine why that was the case.
Ron Hanson said he believed that might be because the old grain elevator and way station used to be there. Jon Winkel said there also used to be a lumber yard nearby.
10. MAYOR'S REPORT:
Jon Winkel announced that he has decided not to run for Mayor again, he will have served for 12 years and 2 months with many different councils. It has been a rewarding experience where much has been accomplished with the staff and councils that he has worked with. He is working with the Sergeant Bluff Advocate to discuss the items accomplished over the last 12 years. He is supportive of Ron Hanson who has filed papers to become Mayor. Ron has been on the City Council for 16 years. Ron has also been supportive to Jon over his tenure. The reason he is not running again is to focus more on his extended family. He also attended the Ribbon Cutting ceremony at Kwik Star, they presented a $1,000 donation to each of the Fire Department and Police Department. The company is very well run, he described a personal story of a spouse of a family member who worked for Kwik Star who became ill where the company was supportive of him throughout his illness. This is their 900th store. He is thankful to Mike & Lori Selig working with Kwik Star during the sale and Jan Harmon's efforts to assist bringing Kwik Star to town.
Ron Hanson confirmed that he has filed paperwork for the Mayor position. He appreciates the positive comments and support he has received since he made the decision to run. It was great to attend the Kwik Star Ribbon Cutting ceremony, they take care of their employees.
