2. APPROVAL OF THE AGENDA:

4. CITIZEN'S INPUT:
Don Welte, 2014 Roundtable Road, explained that he received a letter about being required to mow an area near the trail. He is concerned about the safety of mowing the slope due as his mower can't be safely used on the slope. He discussed alternatives and other changes that should be made to make it feasible.
Jon Winkel stated that they have received responses from other people who received the letter, we're aware there is an issue, staff has been discussing it.
Jason Kvidera said that the City intends to mow it somehow, but Don will need to mow the flat part.
5. APPROVAL OF THE CONSENT AGENDA ITEMS:
5.aSpecial Event Permit Application - Eddie's Pioneer Valley Days Street Dance
Motion by Mark Reinders, seconded by Ron Hanson to Approve the Consent Agenda Items.
Ron Hanson expressed that he attended Eddie's Pioneer Valley Days Street Dance last year, the first band was great but the second band had excessive profanity.
There was discussion about complaints that were heard as a result and what was heard in old town.
Mark Reinders and Ron Hanson withdrew their motion to Approve the Consent Agenda.
Motion by Kirk Moriarty, seconded by Mark Reinders Approve the Special Permit Application for Eddie's Pioneer Valley Days with the exception that if there is a repeat of 2024 where there was profanity in the music, we authorize Sergeant Bluff Police to close it down.
Motion Carried. [Unanimous]
Ryan Panowicz expressed some concern about the potential for a slippery slope.

The Planning & Zoning Commission provided a recommendation letter. There were no public comments received.

6.dOrdinance 764 Amending Chapters 165B and 165D of the Zoning Code (First Reading) 
Andrea Johnson asked why these changes were brought up?
Jon Winkel said that we're trying to allow more things in the industrial park, there are potential interested parties. We're also coming up on the time when we are going to have to make a decision on whether we are going to exercise the options we have on the other side of the road [at Dogwood]. We're trying to be proactive, if we can get a few more things it will make it easier for the Sergeant Bluff Community Development Corporation to justify the financial investment to keep us in the development business on the south side of the road.
Andrea asked if there is anyone is interested in building that this will help out?
Jon said it was more of a general overview of all uses. He discussed the types of interest that has been shown for the area.
Jason Kvidera said the goal is make it more inclusive for what is allowed out there [at Dogwood].
Aaron Lincoln explained that we've had a few that passed on the property because they weren't included as use types.
Motion by Andrea Johnson, seconded by Mark Reinders to Approve Ordinance 764 Amending Chapters 165B and 165D of the Zoning Code (First Reading).

6.fApproval of Pay Estimate #7 to Steve Harris Construction for the Loess Hills Scenic Trail Project (IDOT# TAP-U-6890(611)--8I-97)
Jon Winkel said that we will still have retainage after approving this Pay Estimate. Everything has to be inspected by the IDOT.

7.eORD 765 Amending Chapter 136 Sidewalk Regulations (First Reading)
Andrea Johnson recommended changing 136.08 item six to say "...unless the City Administrator and the Building Official establish..."
Jon Winkel expressed that he'd like to see the sidewalk width be up to 10 feet wide for locations near the trail.
There was extended discussion about changing the width requirements for sidewalks in this first reading.
Andrea proposed changing 136.08 subsection 5(B) to "Business District sidewalks shall extend to the curb. Each section shall be (4) inches thick and a width of between a minimum of five (5) feet and up to ten (10) feet as specified in an approved plan."
Ryan Panowicz asked if there was anything we can do to get people to not park across sidewalks.
There was discussion regarding our ability to address and cite that issue under current code.
Motion by Andrea Johnson, seconded by Ron Hanson to Approve ORD 765 Amending Chapter 136 Sidewalk Regulations (First Reading) with the following changes:
Section 138.08(6) shall read: "Location. Residential sidewalks shall be located with the inner edge (edge nearest the abutting private property) one foot from the property line, unless the City Administrator and the Building Official establish a different distance due to special circumstances."
Section 138.08(5) subsection 5(B): "Business District sidewalks shall extend to the curb. Each section shall be (4) inches thick and a width of between a minimum of five (5) feet and up to ten (10) feet as specified in an approved plan."

7.hORD 768 Amending Chapter 41 Permissible Days and Time Periods for Discharge of Fireworks (First Reading)
Jon Winkel said that the State of Iowa changed the law to mandate fireworks during certain days/hours.
Jereme Muller said it's important that our code matches the State's.
Ron Hanson explained that we created our existing code to match the needs of our community, but the State stepped on Iowa's "Home Rule."

7.iDiscussion of Amending Chapter 47 and 69 - Setting Restrictions on Parking in the Grass on Public Property
Jereme Muller said that the desire would be to prevent people parking in the grass at the Rec Center. It happens during soccer and other sports.
Mark asked if tickets would be issued?
Jereme said there would be parking violation tickets.
Ron Hanson asked if there was a specific area of concern? Jereme said that it occurs around the fields.
There was further discussion about attempts to stop people from doing it, other locations where it could apply and the possible need for no parking signs.
The consensus was to have staff prepare a draft ordinance.
8. ADMINISTRATOR'S REPORT:
Aaron Lincoln distributed a site plan rendering for a new building for Sergeant Bluff EyeCare, he explained that there has been a long term plan to extend the water main from the water plant down to Dogwood, this project will require us to address that sooner. Sioux Valley Credit Union will be having a ribbon cutting on June 17th at 4pm, they remodeled in the interior and added parking. There will be a celebration of life service for Boyd Harman on June 24th at 10am at the Methodist Church.
9. COUNCIL MEMBER'S REPORTS & COMMENTS:
Kirk Moriarty said that the new Venmo signs have been made for the Dog Park for people who want to donate.
Mark Reinders said that the Chamber of Commerce is having an event at Hawks Coffee Shop on June 19th at 7am. The school will be having bond issue meetings on Wednesday and Thursday.
Ron Hanson said that he noticed two rental homes in town that need to be addressed by the Inspector.
He welcomed the new Commander at the 185th, Adam Carlson. The Thunder on the Missouri event had 121 bikes, 17 classic cards, 7 jeeps, and 300+ people. They generated $10,870 dollars to go to the Midwest Honor Flight, after some remaining donations come in it will put them over 12k.
10. MAYOR'S REPORT:
Jon Winkel said that it is amazing how quickly and well orchestrated the Kwik Star is being built, he believes they will be a great community partner. He also stressed the importance of safety in the community, a lot of kids are on scooters.
