4. CITIZEN'S INPUT:
Sandy Morgan, 302 Prairie Bluff Drive, asked when the current phase will be done on 1st Street. She expressed concern regarding the speed of vehicles going through the area where she lives.
Aaron Lincoln said that the Second Phase should be done before school opens on the 23rd. They're working on the intersections this week.
Jon Winkel said that he will assign more police to that area to slow things down.

6. DISCUSSION/ACTION ITEMS:
6.aOpen Public Hearing for Major Site Plan submitted by Kwik Trip Inc
Motion by Kirk Moriarty, seconded by Mark Reinders to Open the Public Hearing at 5:37pm.

6.bPublic Hearing (Public Questions & Comments)
One public comment was submitted prior to the meeting as follows:
Troy Husen, Sergeant Bluff Dental: He does not oppose Kwik Star. He would like to ensure that there is proper drainage and storm sewer for the project.
A response was provided by Aaron Lincoln: The site plan provides grading and culverts to drain the area along the north side of Pub 52 and Sergeant Bluff Dental to the north into the regional pond. The site improves drainage. The culvert elevation is about 2.5 to 3.0 feet lower than the buildings.
There were no other comments from the public.
Mark Reinders asked about the road that might be going in.
Aaron Lincoln said that the road that would be coming from Baker Prairie Bluff from the east. Part of that road will be dedicated to the City. It will connect behind the bank.
Jon Winkel mentioned that Kwik Star has indicated a willingness to move the road more into their property to provide more parking space for other nearby entities.
Travis Small, Real Estate Manager with Kwik Trip Inc, explained that the store was shifted 10-15 north to provide a potential easement location for additional parking for the businesses there. A future discussion could involve who owns and maintains it.
Aaron referenced the Design Review Committee comments that were included in the packet and noted that the Planning & Zoning Commission did recommend approval of the Major Site Plan.

6.e   RES 24-18 Authorizing the Development Agreement with Kwik Trip, Inc. for New Commercial Project
Mark Reinders asked what the time frame was for this moving forward?
Travis Small stated that the pending construction start date is April 2025 and tentative opening date is late September or early October of 2025. They may start moving dirt before April depending on weather. They're hoping to close on the properties this fall.
Carol Clark asked when the Kwik Star is going to open in Sioux City? Travis said he wasn't certain, but possibly November or December this year.
Jon Winkel asked for the information pertaining to when the existing underground tanks would be removed.
Travis described the various agreements in place to accomplish this. They hope to release their contingencies sometime in September, approximately 60 days after that both properties would be closed on. A third party will be brought in to remove the storage tanks.

There were no public comments received. The Planning & Zoning Commission recommended approval of the rezoning.

6.iORD 754 Amend the Zoning Map of the City of Sergeant Bluff (Rezone Property PD To BG) First Reading
Motion by Carol Clark, seconded by Kirk Moriarty to Approve ORD 754 Amend the Zoning Map of the City of Sergeant Bluff (Rezone Property PD To BG) First Reading.

6.jWaiving of Second and Third Readings of Ord 754 Amend the Zoning Map of the City of Sergeant Bluff (Rezone Property PD to BG)
Kwik Trip Inc is requesting that the second and third readings be waived so that they may complete the necessary real estate transactions to close on the property. The ordinance is not effective until publication in the Advocate, so waiving and passing the ordinance on August 27th will not meet a September 1st deadline for real estate purchase agreements.
Jon Winkel explained that the developer is attempting to accomplish this rezone before September 1st. Knowledge of this development is well known to the public at this point, so we're asking that the City Council waive the second and third reading.
Ron Hanson explained that he supports waiving the additional readings to cooperate with Kwik Star to help their process moving along more efficiently and provide potential expansion areas for other businesses.
Andrea Johnson asked how long the public has been aware of the potential rezone.
Sarah Kleber explained that the Planning & Zoning Commission had held public hearings. Danny Christoffers said they met on the 6th of August and we had also mailed notices to property owners within approximately 200 feet.

6.kApproval of Pay Estimate #3 to Steve Harris Construction for the First Street Reconstruction Project (IDOT# STP-U-6890(612)--70-97)
Jon Winkel complimented Steve Harris Construction for their work. Mark Reinders asked if we're on schedule?
Chad Khert, Veenstra & Kimm, explained that the rainy period slowed it down a bit, but they've made up for that recently.
Carol Clark asked if there would be a delay in getting to the next phase before school starts. Chad said he didn't think so.

6.lKristi Franz to provide Presentation for Explore Siouxland (The Sioux City Regional Convention & Visitors Bureau). They are requesting the City continue to offer $5,000 to provide services to Sergeant Bluff for advertising events and promoting tourism in the area. The City completed a three year commitment of $5,000 per year.
Kristi Franz & Barbara Sloniker came to represent Explore Siouxland which is a Convention and Visitor's Bureau organization for the greater Siouxland Region.
Kristi explained that they represent Sioux City, Woodbury County, Sergeant Bluff, North Sioux City, and Dakota Dunes. She described how they are doing some additional hiring, hotel/motel taxes have hit record collections for the communities they represent, events that they directly supported over the last FY24 had a total economic impact of $35 million dollars for the Siouxland Region. They have also sponsored community events, provided 1,000 welcome bags for groups coming into the area, attended 10 marketplace trade shows, added 3 new hotel partners, and participated in various organizations in the region. They are encouraging businesses to add themselves to the website, community events can be posted to the page as well. Various marketing changes were reviewed. The Explore Siouxland Destination Guide was distributed.
Jon Winkel explained that we previously pledge 5k a year for 3 years which has now been completed.
There was discussion regarding what benefits are received by the City of Sergeant Bluff and events that could be promoted through the organization.

7. RESOLUTION(S):
7.aRES 24-19 PROPOSING TRANSFER OF REAL PROPERTY TO BAKER PRAIRIE BLUFF, LLC FOR PROPERTY DEDICATED TO CITY IN ERROR
Jan Harmon, Baker Prairie Bluff LLC, explained that part of the development was mistakenly dedicated to the city. She described various ways they've developed the property.
Sarah Kleber, City Attorney, stated that when there was a dedication of public areas to the City of Sergeant Bluff there were a number of tracts in the legal description that included this tract in error. There will be a public hearing on August 27th and a resolution authorizing the transfer.
Motion by Andrea Johnson, seconded by Kirk Moriarty to Approve RES 24-19 PROPOSING TRANSFER OF REAL PROPERTY TO BAKER PRAIRIE BLUFF, LLC FOR PROPERTY DEDICATED TO CITY IN ERROR.

7.bRES 24-20 APPROVING AGREEMENTS WITH SIOUX CITY BRICK & TILE, LLC FOR PROPERTY TRANSFERS, EASEMENTS, AND LAND LEASE
Jon Winkel described the great cooperation we've had with Sioux City Brick & Tile to accomplish the desire for a new cemetery. This will be the first step in getting a new road to the old and new cemetery.
Sarah Kleber discussed the different agreements and arrangements that will occur, which including property exchange agreements, lease transfers, cost-share of the road, transfer of cemetery plans, and easement changes.
Andrea Johnson asked if this included the lease changes pertaining to the compost site? Sarah said that it includes an extension for the existing site, but the current ground will be substituted for the new ground in the future.
Mark Reinders asked if the cost sharing was only for the road?
Sarah described the way the cost sharing occurs for the road, there are terms for some contingencies.

8. ADMINISTRATOR'S REPORT:
Aaron Lincoln said that the Utility Bill Newsletter will include information about our Garbage company transition to Carrier Container Company, he has a call with them tomorrow. The Library Board has one opening and an upcoming opening; they will meet tomorrow to provide a recommendation. Tyler Tweet and himself are going to meet with the new athletic director with the school. Aaron has a small vacation coming up for August 28-September 3.
9. COUNCIL MEMBER'S REPORTS & COMMENTS:
Andrea Johnson congratulated the Fire Department on their 100 year anniversary, she thanked everyone for their hard work. Monday the 19th will be the final "Market".
Mark Reinders noted that the sidewalk on Warrior Road is nice. He asked about the Loess Hills Trail progress and when it will open - all of the concrete is in place and grading/seeding is the main item left which is subject to Iowa DOT seeding dates. Mark will be traveling during the August 27th Council meeting and may try to participate remotely.
Kirk Moriarty mentioned working with Aaron Lincoln on tree planting grants for Old Town.
General comments of the Council related to: 1) School starts next Friday so please be careful as you commute and travel; 2) Thanks for supporting Pioneer Valley Days (PVD) and the parade was well received; 3) Thank you to the volunteers for PVD and other community events
The Mayor and City Council offered their condolences to Aaron Johnson on the recent passing of his Mother.
10. MAYOR'S REPORT:
Jon Winkel wanted to emphasize safety with all the construction going on in town and kids running around. Please be careful. He discussed the recent passing of Aaron Johnson's Mother, he encouraged people to reach out to him and raise his family up in prayer.
