City of Sergeant Bluff, Iowa - ORDINANCE NO. 757

AN ORDINANCE AMENDING PROVISIONS OF THE  CODE OF ORDINANCES OF THE CITY OF SERGEANT BLUFF, IOWA  PERTAINING TO COLLECTION FEES FOR SOLID WASTE AND SETTING THE PRICE PER RESIDENTAL PREMISES AND PLACE OF BUSINESS FOR WOODBURY COUNTY SOLID WASTE AGENCY’S GENERAL OPERATIONS AND RECYCLING 

WHEREAS, the City of Sergeant Bluff, Iowa, provides solid waste collection, landfill operations, and recycling services for the property owners within the City limits; and

WHEREAS, costs relating to solid waste collection, landfill operations, and recycling have risen and will continue to rise; and 

WHEREAS, the City of Sergeant Bluff, Iowa, by Resolution 07-06, set a fee for landfill operations and recycling services, which the City desires to include in the solid waste ordinance; and

WHEREAS, the City Council of the City of Sergeant Bluff, Iowa, has determined that users of solid waste collection, landfill operations, and recycling services should pay for such operations by payment of collection fees, which must be adjusted from time to time to reflect cost increases; 

NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF SERGEANT BLUFF, IOWA:

SECTION 1.    SECTION MODIFIED.  Chapter 106, Section 08, Subsection 1 of the Code of Ordinances of the City of Sergeant Bluff, Iowa is repealed and the following adopted in lieu thereof:

1.Schedule of Fees. The fee for solid waste collection and disposal service, used or available, for each residential premises and for each dwelling unit of a multiple-family dwelling is $19.75 per month for the collection of one 95-gallon container each week. The fee for collection of a second 95-gallon container is $10.00 per month and the fee for each additional container thereafter is $6.00 per month. Additional bags, cans, bundles and household items may also be set out for collection in accordance with collector specifications, but each can, bag bundle, or item must have a City sticker attached thereto. The fee for landfill operations and recycling at a residential premises and place of business shall be charged at a rate of $6.25 per month.

SECTION 2.   SEVERABILITY.  If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.  

SECTION 3.   EFFECTIVE DATE.  This ordinance shall be in effect from and after its final passage, approval, and publication as provided by law.  The rates are to be effective for the utility billing due after the passage of the ordinance.
