AN ORDINANCE AMENDING CHAPTERS 15 AND 35 OF THE CODE OF ORDINANCES RELATING TO THE FIRE CHIEF, STRUCTURE AND ORGANIZATION OF THE CITY’S FIRE RESCUE SERVICES
BE IT ORDAINED by the City Council of the City of Sergeant Bluff, Iowa:
SECTION 1.SECTION MODIFIED. Section 15.03 of the Code of Ordinances of the City of Sergeant Bluff, Iowa is repealed and the following is adopted in lieu thereof:
15.03APPOINTMENTS.
The Mayor shall appoint the following officials:

2.Parks and Recreation Board
3.Community Action Team
4.Police Chief
5.Fire Chief
SECTION 2. SECTION MODIFIED. Section 35.01 of the Code of Ordinances of the City of Sergeant Bluff, Iowa is repealed and the following is adopted in lieu thereof:
35.01 ESTABLISHMENT AND PURPOSE.
The City’s fire and rescue service, to be known as the “Sergeant Bluff Fire Rescue,” is hereby established to prevent and extinguish fires, to protect lives and property against fires, to promote fire prevention and fire safety, and to provide emergency medical, ambulance and rescue services on a 24-hour per day basis, and to answer all emergency calls for which there is no other established agency.
SECTION 3.SECTION MODIFIED. Section 35.02 of the Code of Ordinances of the City of Sergeant Bluff, Iowa is repealed and the following is adopted in lieu thereof:
35.02 ORGANIZATION.
Sergeant Bluff Fire Rescue is a combination paid/volunteer organization that consists of one company including a full-time paid Fire Chief and such other volunteer members as may be authorized by the Council. Sergeant Bluff Fire Rescue shall maintain a membership roster in staffing categories in numbers approved by the Council. Sergeant Bluff Fire Rescue shall determine appropriate residency requirements for all volunteer members. All members must be persons of good moral character and strong physical condition. Vacancies in Sergeant Bluff Fire Rescue for volunteer members from whatever cause may be filled by persons who can satisfactorily pass Sergeant Bluff Fire Rescue’s entry qualifications and other job requirements. Qualified volunteer applicants approved and screened by Sergeant Bluff Fire Rescue shall be submitted to the Council for approval.
1.A high school membership program shall be allowed with certain restrictions as directed by the Fire Chief and described in Sergeant Bluff Fire Rescue’s policies.
2.Sergeant Bluff Fire Rescue may establish classifications and requirements based on residency, firefighting and emergency medical service qualifications, and age.
SECTION 4.SECTION MODIFIED. Section 35.03 of the Code of Ordinances of the City of Sergeant Bluff, Iowa is repealed and the following is adopted in lieu thereof:
35.03 APPROVED BY COUNCIL.
No person having otherwise qualified and satisfying Sergeant Bluff Fire Rescue’s entry and other job requirements shall be appointed as a member of Sergeant Bluff Fire Rescue until such appointment is submitted upon recommendation by the Fire Chief and approved by a majority of the Council members.
SECTION 5.SECTION MODIFIED. Section 35.04 of the Code of Ordinances of the City of Sergeant Bluff, Iowa is repealed and the following is adopted in lieu thereof:
35.04 TRAINING.
All Fire and EMS members of Sergeant Bluff Fire Rescue shall meet the minimum training standards established by the State Fire Marshal, Department of Public Health, and Iowa Administrative Code that are applicable to each member’s certification. All members shall actively participate in regular or special training drills or programs as directed by the Fire Chief and required in Sergeant Bluff Fire Rescue policies.
SECTION 6.SECTION MODIFIED. Section 35.05 of the Code of Ordinances of the City of Sergeant Bluff, Iowa is repealed and the following is adopted in lieu thereof:
35.05 COMPENSATION.
City employee and volunteer members of Sergeant Bluff Fire Rescue shall be designated by rank and receive such compensation or stipend as shall be determined by resolution of the Council.
SECTION 7.SECTION MODIFIED. Section 35.06 of the Code of Ordinances of the City of Sergeant Bluff, Iowa is repealed and the following is adopted in lieu thereof:
35.06 APPOINTMENT AND TERM OF OFFICERS.
1.The Mayor shall appoint and dismiss the Fire Chief subject to the consent of the City Council.
2.Sergeant Bluff Fire Rescue members shall elect officers with certain terms in accordance with the organization’s bylaws.
3.The Fire Chief shall appoint from the membership Captains and Lieutenants as needed for the command structure.
SECTION 8.SECTION MODIFIED. Section 35.07 of the Code of Ordinances of the City of Sergeant Bluff, Iowa is repealed and the following is adopted in lieu thereof:
35.07 FIRE CHIEF: DUTIES.
Fire Chief. During the time of a fire or any other emergency, the Chief shall be in command of Sergeant Bluff Fire Rescue and shall direct the efforts of the officers and individual members of Sergeant Bluff Fire Rescue in the use of all apparatus and equipment. The Fire Chief shall also be responsible for holding training sessions as needed, for the supervision and control over Sergeant Bluff Fire Rescue’s apparatus and equipment, and for reporting to the Mayor and Council, as frequently as deemed necessary by the Mayor and Council, all matters pertaining to Sergeant Bluff Fire Rescue or its activities. The Fire Chief shall establish such policies and rules for Sergeant Bluff Fire Rescue not in conflict with this Code as may be necessary for the operation of Sergeant Bluff Fire Rescue. Additional duties include but are not limited to:
1.Enforce Laws. Enforce ordinances and laws regulating fire prevention and the investigation of the cause, origin, and circumstances of fires.
2.Technical Assistance. Upon request, give advice concerning private fire alarm systems, fire extinguishing equipment, fire escapes and exits, and development of fire emergency plans.
3.Authority at Fires. When in charge of a fire scene, direct an operation as necessary to extinguish or control a fire, perform a rescue operation, investigate the existence of a suspected or reported fire, gas leak, or other hazardous condition, or take any other action deemed necessary in the reasonable performance of Sergeant Bluff Fire Rescue’s duties.
4.Control of Scenes. Prohibit an individual, vehicle or vessel from approaching a fire scene and remove from the scene any object, vehicle, vessel or individual that may impede or interfere with the operation of Sergeant Bluff Fire Rescue.
5.Authority to Barricade. When in charge of a fire scene, place or erect ropes, guards, barricades or other obstructions across a street, alley, right-of-way, or private property near the location of the fire or emergency so as to prevent accidents or interference with the firefighting efforts of Sergeant Bluff Fire Rescue, to control the scene until any required investigation is complete, or to preserve evidence related to the fire or other emergency.
6.Command. Be charged with the duty of maintaining the efficiency, discipline, and control of Sergeant Bluff Fire Rescue. The members of Sergeant Bluff Fire Rescue shall, at all times, be subject to the direction of the Fire Chief. In consultation with the City Administrator and the City Attorney, the Fire Chief may remove or terminate any person from their office or position in Sergeant Bluff Fire Rescue including but not limited to Assistant Chiefs, Captains, Lieutenants, Firefighters, EMTs, paid on-call members, or volunteers.
7.Property. Exercise and have full control over the disposition of all fire apparatus, tools, equipment, and other property used by or belonging to Sergeant Bluff Fire Rescue.
8.Notification. Whenever death, serious bodily injury, or property damage in excess of two hundred thousand dollars ($200,000) has occurred as a result of a fire, or if arson is suspected, notify the State Fire Marshal’s Division immediately. For all other fires causing an estimated damage of fifty dollars ($50.00) or more or emergency responses by Sergeant Bluff Fire Rescue, file a report with the Fire Marshal’s Division within ten (10) days following the end of the month. The report shall indicate all fire incidents occurring and state the name of the owners and occupants of the property at the time of the fire, the value of the property, the estimated total loss to the property, origin of the fire as determined by investigation, and other facts, statistics, and circumstances concerning the fire incidents.
9.Right of Entry. Have the right, during reasonable hours, to enter any building or premises within the Fire Chief’s jurisdiction for the purpose of making such investigation or inspection which under law or ordinance may be necessary to be made and is reasonably necessary to protect the public health, safety, and welfare.
10.Recommendation. Make such recommendations to owners, occupants, caretakers, or managers of buildings necessary to eliminate fire hazards.
11.Assist State Fire Marshal. At the request of the State Fire Marshal, and as provided by law, aid said marshal in the performance of duties by investigating, preventing and reporting data pertaining to fires.
12.Records. Cause to be kept records of Sergeant Bluff Fire Rescue personnel, firefighting equipment, depreciation of all equipment and apparatus, the number of responses to alarms, their cause, and location, and an analysis of losses by value, type and location of buildings.
13.Reports. Compile and submit to the Mayor and Council an annual report of the status and activities of Sergeant Bluff Fire Rescue as well as such other reports as may be requested by the Mayor and Council.
SECTION 9. SECTION MODIFIED. Section 35.09 of the Code of Ordinances of the City of Sergeant Bluff, Iowa is repealed and the following is adopted in lieu thereof:
35.09 SERGEANT BLUFF FIRE RESCUE VOLUNTEER ORGANIZATION.
Sergeant Bluff Fire Rescue members have separately adopted a constitution and bylaws which shall be maintained and amended by their organization as needed to promote Sergeant Bluff Fire Rescue’s command, membership, welfare and capabilities of volunteer fire fighters and emergency medical service providers engaged in fire protection, rescue and ambulance services. Such constitution and bylaws and any change or amendment to such constitution and bylaws before being effective, must be approved by the Council.
SECTION 10. SECTION MODIFIED. Section 35.10 of the Code of Ordinances of the City of Sergeant Bluff, Iowa is repealed and the following is adopted in lieu thereof:
35.10 ACCIDENTAL INJURY INSURANCE.
The Council shall contract to insure the City against liability for workers’ compensation and against statutory liability for the costs of hospitalization, nursing, and medical attention for all members (Fire and EMS) injured in the performance of their duties whether within or outside the corporate limits of the City. All City employee and volunteer members shall be covered by the insurance contract.
SECTION 11. SECTION MODIFIED. Section 35.11 of the Code of Ordinances of the City of Sergeant Bluff, Iowa is repealed and the following is adopted in lieu thereof:
35.11 LIABILITY INSURANCE.
The Council shall contract to insure against liability of the City or members of Sergeant Bluff Fire Rescue for injuries, death or property damage arising out of and resulting from the performance of Sergeant Bluff Fire Rescue’s duties within or outside the corporate limits of the City.
SECTION 12. SECTION MODIFIED. Section 35.12 of the Code of Ordinances of the City of Sergeant Bluff, Iowa is repealed and the following is adopted in lieu thereof:
35.12 JOINT AGREEMENT WITH WOODBURY TOWNSHIP.
The City has entered into an agreement with the Woodbury County Trustees, Woodbury Township, Woodbury County, Iowa, for the joint use, maintenance, and purchasing of fire equipment, and Sergeant Bluff Fire Rescue shall furnish fire protection, emergency medical rescue and disaster services to all persons and property within Woodbury Township, Woodbury County, Iowa, as well as in the City.
SECTION 13. SECTION MODIFIED. Section 35.13 of the Code of Ordinances of the City of Sergeant Bluff, Iowa is repealed and the following is adopted in lieu thereof:
35.13 MUTUAL AID.
Subject to approval by resolution of the Council, Sergeant Bluff Fire Rescue may enter into mutual aid agreements with other legally constituted fire departments. Copies of any such agreements shall be filed with the Clerk.
SECTION 14. SECTION MODIFIED. Section 35.14 of the Code of Ordinances of the City of Sergeant Bluff, Iowa is repealed and the following is adopted in lieu thereof:
35.14 VIOLATIONS AND AUTHORITY TO CITE.
1. Any person, firm or corporation violating any provisions of this Chapter is guilty of a municipal infraction and shall upon conviction, be penalized according to the provisions of Chapter 4 of this Code of Ordinances. Each violation shall be a separate offense, even if repeated violations occur on the same day.
2. The Fire Chief, the Assistant Chief or their designee are municipal code enforcement officers for the limited purpose of enforcing the provisions of this chapter which are made their responsibility to enforce. Enforcement officers shall have discretion to determine the appropriate actions necessary according to the circumstances. They may provide education, assess fire service fees, or issue warning or citation charging a violation of any provision in this municipal code for which it is their responsibility to enforce and no other. This section shall not be interpreted to require the issuance of citations. The issuance procedure shall be as required by the laws of the State of Iowa and Chapter 4 of this Code applicable to municipal infractions.
3. Fire officials acting under the authority of Chapter 100 of the Code of Iowa may issue citations in accordance with Chapter 805 of the Code of Iowa, for violations of State and/or local fire safety regulations.
SECTION 15. SECTION REPEALED. The Code of Ordinances of the City of Sergeant Bluff, Iowa, is hereby amended by repealing Section 35.15 which separately authorized emergency ambulance service and related insurance requirements.
SECTION 16. SECTION MODIFIED. Section 35.16 of the Code of Ordinances of the City of Sergeant Bluff, Iowa is repealed and the following is adopted in lieu thereof:
35.16 ADOPTION OF FIRE CODE.
1.The 2024 Edition of the International Fire Code, published by the International Code Council (ICC), is hereby adopted by reference as the Fire Code of the City of Sergeant Bluff, Iowa, except for such portions as are modified herein, regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the occupancy of buildings and premises as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Fire Code on file and available for public reference in the office of the City Clerk in City Hall and at the Sergeant Bluff Fire Rescue station located at 204 Port Neal Road are hereby referred to, adopted, and made a part hereof, as if fully set out in this legislation, with the additions, insertions, deletions and changes prescribed in subsection 2 as follows.
2.The following sections and portions of the 2024 Edition of the International Fire Code are hereby amended, deleted, modified, or added in said code as follows:
A.Section 101.1 – “[NAME OF JURISDICTION]” shall be replaced with “the City of Sergeant Bluff, Iowa.”
B.Section 103.1 – Delete the subsection and replace with: “Sergeant Bluff Fire Rescue has been established created, and the Fire Chief, or designee authorized by the Fire Chief, shall also be known as the Fire Code Official. A function of the agency shall be the implementation, administration and enforcement of the provisions of this code.”
C.Section 104 – Add a new Subsection 104.12 to Section 104 to read as follows: “The Fire Code Official is authorized to order an operation or use stopped or the evacuation of any premises, building, or vehicle or portion thereof which has or is a fire, life safety or health hazard.”
D.Section 105.5 – Add a sentence to the end of the section to read as follows: “The Fire Code Official at their discretion may send plans for operational permits requests to an outside agency for review. The Fire Code Official shall choose the review agency. The applicant shall pay all fees associated with the plan review directly to the outside agency. The permit shall not be issued until the review fees have been paid.”
E.Section 105.6 – Add a sentence to the end of the section to read as follows: “The Fire Code Official at their discretion may send construction plans to an outside agency for review. The Fire Code Official shall choose the review agency. The applicant shall pay all fees associated with the plan review directly to the outside agency. The permit shall not be issued until the review fees have been paid.”
F.Section 112.1 – Delete the section and replace with: “The City [Administrator or Council] shall hear and decide appeals of orders, decisions or determinations made by the Fire Code Official relative to the application and interpretation of this code. As needed, the City [Administrator or Council] shall adopt rules of procedure for review of appeals and shall render all decisions and findings in writing to the appellant with a duplicate copy to the Fire Code Official.
G.Sections 112.2 and 112.4 – Replace references to board with” City [Administrator or Council].
H.Section 112.3 – Delete the section.
I.Section 113.4 – Delete the section and replace with: “Persons who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter, repair or do work in violation of the approved construction documents or directive of the Fire Code Official, or of a permit or certificate used under provisions of this code, shall be punishable by civil penalty for a municipal infraction, as prescribed in the City of Sergeant Bluff Code of Ordinances.”
J.Section 114.4 – Delete the section and replace with: “Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition and shall be punishable by civil penalty for a municipal infraction, as prescribed in the City of Sergeant Bluff Code of Ordinances.”
K.Section 307.1 – Delete the section and replace with: “A person shall not kindle or maintain or authorize to be kindled or maintained any open burning unless conducted and approved by the Fire Chief in accordance with IFC Code Section 307 and City of Sergeant Bluff Code of Ordinances Section 41.15 Recreational Fires, Section 105.05 Open Burning for Solid Waste Disposal, Section 135.08 Burning Prohibited, and any other current or future municipal ordinances addressing Open Burning, Recreational Fires, and Portable Outdoor Fireplaces.”
L.Section 401 – Add a new subsection to Section 401 to read as follows: “401.9 Building Evacuation. Upon activation of the building fire alarm system or upon notification by other means of detecting and reporting unwanted fire, all building occupants shall promptly evacuate the building. Building employees and tenants shall implement the appropriate emergency plan and procedures. Except that immediate total evacuation of the building is not required when the emergency evacuation plan for the building, as approved by the Fire Code Official, does not require it..”
M.Section 505 – Add a new subsection to Section 505 to read as follows: “505.3 Addresses for Buildings under Construction. Upon permit issuance, all new commercial and residential buildings under construction shall have address signage plainly visible from the street. Additional address signage may be required at the discretion of the Fire Code Official.”
N.Section 506 – Delete the section. All requirements for key boxes shall be in accordance with the City of Sergeant Bluff Code of Ordinances Section 35.18 Knox Box Requirements.
O.Section 507.5 – Add a sentence to the end of the section to read as follows: “Fire hydrant systems shall also comply with the City of Sergeant Bluff Code of Ordinances Section 35.19 Connection Hydrant Requirements and Section 90.19 Operation of Curb Valve and Hydrants. The brand of fire hydrant installed on the public water system shall be approved by the Sergeant Bluff Public Works Department prior to installation.”
P.Section 507 – Add a new subsection to Section 505.5 to read as follows: “507.5.7 Fire hydrant height: Fire hydrants shall be installed a minimum of sixteen (16) inches from the nominal ground level to the center of the lowest water outlet.”
Q.Section 901.1 – Add a sentence to the end of the section to read as follows: “The provisions of this chapter shall also include the City of Sergeant Bluff Municipal Code Section 35.20 Fire Alarm & Detection Systems Requirements.”
R.Section 901.6.3 – Add a new subsection to Section 901.6.3 to read as follows: “901.6.3.2 Inspection Record Submission. Contractors who perform installation, inspection, testing and/or maintenance services on fire and life safety systems are required to electronically submit all installation and compliant & non-compliant inspection reports to the Fire Chief via a method approved by the Fire Code Official within 30 calendar days of the installation/inspection date. Reports submitted after 30 calendar days may incur late fees.”
S.Section 1103.5.3 – “[DATE BY WHICH SPRINKLER MUST BE INSTALLED]” is amended to “two years from date of notification.”
T.Section 1103 – Add a new section to Section 1103 to read as follows: “1103.11 Existing Fire Alarm Systems Monitoring Requirements. Existing fire alarms systems that are currently not monitored by an approved UL listed Central Station shall become monitored within 1 year from receiving notice in accordance with Section 907.6.6.”
U.Section 1103 – Add a new section to Section 1103 to read as follows: “Existing sprinkler systems monitoring requirements. Existing sprinkler systems shall have all valves controlling the sprinkler system and water flow electrically supervised and monitored by an approved UL listed Central Station in accordance with Sections 903.4 and 903.4.1 within 1 year from receiving notice.”
3.The requirements as provided for by Chapter 35 Sections 35.17, 35.19 and 35.20 shall continue to apply and all provisions of the 2024 Edition of the International Fire Code in conflict with the provisions of Sergeant Bluff Code of Ordinances Sections 35.17, 35.19 and 35.20 shall not apply.
SECTION 17. SECTION MODIFIED. Section 35.18 of the Code of Ordinances of the City of Sergeant Bluff, Iowa is repealed and the following is adopted in lieu thereof:
35.18 KNOX BOX REQUIREMENTS.
All commercial structures and all multi-residential structures other than duplex homes receiving a building permit on or after October 1, 2015, shall be equipped with a Knox box brand high security key vault keyed to the configuration set forth by the Fire Chief. Knox box key access shall not include any areas used for storage of narcotic drugs and medications. Use of the Knox box system shall authorize Sergeant Bluff Fire Rescue to obtain access to the buildings when responding to an emergency at the property.
1. All Knox boxes must be of the type and size approved by the Fire Chief.
2. All Knox boxes must be keyed to the City's specifications using forms for the City of Sergeant Bluff, available at Sergeant Bluff Fire Rescue.
3. All Knox boxes shall be installed in the location designated by the Fire Chief. The unit shall be surface mounted to the structure with bolts using the instructions included with the Knox box. Caulking shall be applied to three sides, leaving the bottom open.
4. All Knox boxes for each building shall have clearly marked keys to the following areas:
A. The main entrance door/doors.
B. All alarm rooms.
C. All mechanical and sprinkler rooms.
D. The fire alarm control panel.
E. All electrical rooms.
F. Elevator keys, if required.
G. All other rooms deemed necessary by the Fire Chief.
5. The owner or person in control of any building or facility required to have a Knox box shall provide keys and updated sets of keys capable of access to the areas described herein, notify the Fire Chief when a key change is made and coordinate replacement of the keys in the Knox box, and allow reasonable access for inspection.
SECTION 18. SECTION MODIFIED. Section 35.19 of the Code of Ordinances of the City of Sergeant Bluff, Iowa is repealed and the following is adopted in lieu thereof:
35.19 CONNECTION HYDRANT REQUIREMENTS.
All fire hydrants installed or repaired on or after October 1, 2015, must be equipped with a Storz type quick release connector compatible with hose couplings currently used by Sergeant Bluff Fire Rescue.
SECTION 19. SECTION MODIFIED. Section 35.20 of the Code of Ordinances of the City of Sergeant Bluff, Iowa is repealed and the following is adopted in lieu thereof:
35.20 FIRE ALARM & DETECTION SYSTEMS REQUIREMENTS.
1. If a fire alarm and detection system is installed or required to be installed by state law or regulation for the building or use, the system must comply with and complete all maintenance for such systems as provided for by the applicable sections of the state adopted edition of the International Fire Code, Section 907, and in accordance with the National Fire Alarm and Signaling Code, NFPA 72.
2. If a fire alarm and detection system is installed or required to be installed for the building or use, the system must be inspected by a state qualified inspector on an annual basis. A tag, purchased from the City, showing proof of inspection, signed by the inspector, including the date the inspection was completed shall be affixed to the system/box. Failure to inspect or to properly tag a system within the current year shall be a violation.
3. If a fire alarm and detection system is activated and alarms, unless there exists special evacuation plan approved by the Fire Chief, all building occupants must evacuate and relocate to a safe area outside of the building until Sergeant Bluff Fire Rescue personnel respond and advise that the structure is cleared for re-entry.
4. Sergeant Bluff Fire Rescue personnel may determine that an alarm was false and did not need to be activated. Recurring false alarms from fire alarm and detection systems shall result in service fees being assessed against the system owner or building occupant responsible for the area triggering the alarms.
A. Upon receipt of the second false alarm within a calendar year, a warning notice may be issued to the alarm system user and the alarm business monitoring system. Upon any additional false alarms, a causation report must be filed with the Fire Chief by the alarm system user within ten days of the false alarm.
B. Upon receipt of the third false alarm within a year, the alarm system user shall be subject to service fees to be paid to the City withing thirty days after notice that it is due.
C. For accounting purposes, all false alarms in a twenty-four-hour period (from noon to noon), with a maximum of three, will be counted as one. Any additional alarms during that period will be counted as additional false alarms.
D. For newly installed alarm systems, the schedule of false alarms service fees shall become effective after three false alarms have occurred or sixty days after installation of the new alarm system whichever occurs first. During this grace period, false alarms will not be chargeable for fire service fees.
SECTION 20. CHAPTER RENAMED. Chapter 35 of the Code of Ordinances of the City of Sergeant Bluff, Iowa, is hereby renamed as “FIRE RESCUE SERVICE.”
SECTION 21. REPEALER. All ordinances of parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. In all other respects, the Code of Ordinance of the City of Sergeant Bluff shall remain in effect.
SECTION 22. SEVERABILITY CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
