ORDINANCE NO. 763
AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF SERGEANT BLUFF, IOWA BY REPEALING SECTION 62.10 AND ADDING A NEW CHAPTER 74 TO PROVIDE FOR THE OPERATION OF GOLF CARTS ON CITY STREETS
BE IT ENACTED by the City Council of the City of Sergeant Bluff, Iowa:
SECTION 1. SECTION REPEALED. The Code of Ordinances of the City of Sergeant Bluff, Iowa, is hereby amended by repealing Section 62.10 which limited the operation of golf carts on City streets to special events. The remaining paragraphs of Chapter 62 shall be renumbered.
SECTION 2. NEW CHAPTER. The Code of Ordinances of the City of Sergeant Bluff, Iowa, is amended by adding a new Chapter 74, entitled “GOLF CARTS,” which is hereby adopted to read as follows:

74.01 GENERAL REGULATIONS.
The City allows the operation of golf carts on City streets and adopts by reference the provisions of Section 321.247 of the Code of Iowa pertaining to golf cart operation on City streets. No person shall operate a golf cart on City streets in violation of all applicable provisions of Section 321.274 or the additional local safety requirements of this chapter.
74.02 SAFETY REQUIREMENTS TO OPERATE.
The following safety requirements shall apply to golf care operation on City streets or trails:
1.The driver of the golf cart shall be at least eighteen (18) years old and possess a valid driver’s license.
2.The driver may allow passengers, but only so many as the golf cart is designed to carry. All passengers must be seated in a seat designed for carrying passengers.
3.Golf carts may only be operated on City streets or trails from sunrise to sunset.
4.Golf carts shall be equipped with adequate brakes, a slow-moving vehicle sign and a bicycle safety flag.
5.The golf cart must be brought to a complete stop before crossing a street, and the driver of the golf cart must yield the right-of-way to all oncoming traffic that constitutes an immediate hazard.
6.The golf cart, if operating on a trail, must yield the right-of-way to all other traffic.
7.All owners of golf carts operated on City streets and trails must obtain a permit from City Hall and affix a City issued sticker to any cart prior to use on City streets and trails pursuant to a policy and fees set by Resolution of the Council.
74.03 PROHIBITED STREETS AND WALKWAYS.
1.Within the corporate limits of the City, golf carts shall not be operated upon the following City streets or walkways:
A.South Lewis Boulevard/Old U.S. Highway 75
B. First Street/210th Street
C. Old Lakeport Road
D. 8th Street
E. West Ridge Road
F. Dogwood Trail
G. 220th Street
H. Recreational trails and sidewalks less than eight (8) feet wide
2.Golf carts shall be allowed to cross such prohibited streets directly and without delay.
SECTION 3. REPEALER. All ordinances of parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. In all other respects, the Code of Ordinance of the City of Sergeant Bluff shall remain in effect.
SECTION 4. SEVERABILITY CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
SECTION 5.WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval, and publication as provided by law.
