ORDINANCE NO. 768
AN ORDINANCE AMENDING CHAPTER 41 OF THE CODE OF ORDINANCES OF THE CITY OF SERGEANT BLUFF, IOWA, BY AMENDING THE PERMISSIBLE DAYS AND TIME PERIODS FOR DISCHARGING FIREWORKS
BE IT ENACTED by the City Council of the City of Sergeant Bluff, Iowa:
SECTION 1. SECTION MODIFIED. Section 41.13, subsection 3., paragraph E. located in Chapter 41 of the Code of Ordinances of the City of Sergeant Bluff, Iowa, is repealed and the following adopted in lieu thereof:
41.13 FIREWORKS.
3. Discharging – Regulation.
E. No person shall discharge a consumer fireworks device, and no person owning or possessing real property, or otherwise having apparent authority or control over real property, shall permit the discharge of any fireworks device upon such property, outside the following dates and hours:
(1) July 3 from the hours of 9:00 A.M. until midnight.
(2) July 4 from the hours of 9:00 A.M. until and up to 12:00 A.M. (midnight).
(3) December 31 from the hours of 9:00 A.M. until midnight.
SECTION 2. REPEALER. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. In all other respects, Chapter 41 of the Code of Ordinances of the City of Sergeant Bluff, Iowa shall remain in effect as previously adopted.
SECTION 3. SEVERABILITY CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
SECTION 4. WHEN EFFECTIVE. This ordinance shall be in effect beginning on July 1, 2025, after its final passage and approval and publication as provided by law.
