City of Sergeant Bluff, Iowa - ORDINANCE NO. 777

An Ordinance Deleting Property from the Tax Increment Financing District for the Consolidated Sergeant Bluff Urban Renewal Area of the City of Sergeant Bluff, Iowa, Pursuant to Section 403.19 of the Code of Iowa

WHEREAS, the City Council of the City of Sergeant Bluff, Iowa (the “City”) previously enacted certain ordinances providing for the division of taxes levied on taxable property in the Consolidated Sergeant Bluff Urban Renewal Area pursuant to Section 403.19 of the Code of Iowa; and

WHEREAS, pursuant to said ordinances, portions of the Consolidated Sergeant Bluff Urban Renewal Area in the City of Sergeant Bluff were designated as “tax increment districts”; and

WHEREAS, the City Council now desires to decrease the size of the “tax increment districts” by deleting certain property;

BE IT ENACTED by the City Council of the City of Sergeant Bluff, Iowa:

Section 1. Purpose.  The purpose of this ordinance is to delete certain property from the tax increment financing districts for the Consolidated Sergeant Bluff Urban Renewal Area.

Section 2. Definitions.  For use within this ordinance the following terms shall have the following meanings:

“Deleted Property” shall mean certain real property situated in the City of Sergeant Bluff, Woodbury County, State of Iowa more particularly described as follows:

A PARCEL OF LAND LOCATED IN THE W1/2 NW1/4 OF SECTION 5 AND THE E1/2 OF SECTION 6 T87N, R47W OF THE 5TH PRINCIPAL MERIDIAN, WOODBURY COUNTY, IOWA. SAID PARCEL MORE PARTICULARLY DESCRIBED AS FOLLOWS:

COMMENCING AND BEGINNING AT THE E1/4 CORNER OF SECTION 6 THENCE S89°39'55"E (AN ASSUMED BEARING) ALONG THE SOUTH LINE OF THE NW1/4 SECTION 5, 1285.57 FEET; THENCE N03°11'43"E 1450.54 FEET; THENCE N47°46'24"W 339.10 FEET TO THE PC OF A CURVE ON THE SOUTHEASTERLY ROW LINE OF DOGWOOD TRAIL; THENCE S42°13'36"W 93.15 FEET; THENCE ALONG A CURVE CONCAVE NORTHWESTERLY WITH AN ARC LENGTH OF 586.73 FEET, RADIUS OF 700.00 FEET, WITH A CHORD OF S66°14'20"W 569.70 FEET; THENCE N89°44'56"W ALONG THE SOUTH ROW LINE OF DOGWOOD TRAIL, 816.35 FEET; THENCE S03°48'42"W 1213.23 FEET TO THE NORTHEASTERLY ROW LINE OF BANNER AVE; THENCE S44°17'59"E ALONG SAID ROW LINE, 299.29 FEET; THENCE ALONG A CURVE CONCAVE SOUTHWESTERLY WITH AN ARC LENGTH OF 223.08 FEET, RADIUS OF 1333.00 FEET, WITH A CHORD OF S39°30'19"E 222.82 FEET TO THE EAST LINE OF SECTION 6; THENCE N03°50'00"E ALONG SAID EAST LINE OF SECTION 6, 223.45 FEET TO THE POINT OF BEGINNING. 

SAID PARCEL CONTAINS 54.66 ACRES MORE OR LESS.

AND

A PARCEL OF LAND LOCATED IN THE NW1/4 OF SECTION 5 T87N, R47W OF THE 5TH PRINCIPAL MERIDIAN, WOODBURY COUNTY, IOWA. SAID PARCEL MORE PARTICULARLY DESCRIBED AS FOLLOWS:

COMMENCING AT THE E1/4 CORNER OF SECTION 6 THENCE S89°39'55"E (AN ASSUMED BEARING) ALONG THE SOUTH LINE OF THE NW1/4 SECTION 5, 1285.57 FEET TO THE POINT OF BEGINNING; THENCE N03°11'43"E, 1450.54 FEET; THENCE N47°46'24"W 339.10 FEET TO THE PC OF A CURVE ON THE SOUTHEASTERLY ROW LINE OF DOGWOOD TRAIL; THENCE ALONG A CURVE CONCAVE SOUTHEASTERLY WITH AN ARC LENGTH OF 299.60 FEET, RADIUS OF 450.00 FEET, WITH A CHORD OF N61°18'00"E 294.10 FEET; THENCE N80°22'23"E ALONG SAID SOUTHEASTERLY ROW LINE OF DOGWOOD TRAIL 233.94 FEET; THENCE ALONG A CURVE CONCAVE SOUTHEASTERLY WITH AN ARC LENGTH OF 84.95 FEET, RADIUS OF 450.00 FEET, WITH A CHORD OF N85°46'53"E 84.83 FEET; THENCE S88°48'37"E ALONG THE SOUTH ROW LINE OF DOGWOOD TRAIL, 101.38 FEET TO THE WEST ROW LINE OF THE UNION PACIFIC RAILROAD; THENCE S27°12'23"E ALONG SAID WEST ROW LINE, 1961.67 FEET TO THE EAST LINE OF THE NW1/4 SECTION 5; THENCE S02°32'09"W ALONG SAID EAST LINE, 124.30 FEET TO THE CENTER OF SECTION 5; THENCE N89°39'55"W ALONG THE SOUTH LINE OF THE NW1/4 SECTION 5, 1395.70 FEET TO THE POINT OF BEGINNING. 

SAID PARCEL CONTAINS 40.94 ACRES MORE OR LESS.

Section 3. The Deleted Property is hereby removed from the tax increment financing district for the Consolidated Sergeant Bluff Urban Renewal Area. No division of property tax revenues as provided under Section 403.19 of the Code of Iowa shall be done with respect to the Deleted Property without further action by the City Council.

Section 4. Repealer.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

Section 5. Saving Clause.  If any section, provision, or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.

Section 6. Effective Date.  This ordinance shall be effective after its final passage, approval and publication as provided by law.
