ORDINANCE NO. 756

BE IT ORDAINED by the City Council of the City of Sergeant Bluff, Iowa, that:

SECTION 1.  SECTION MODIFIED. Section 35.07 subsection (6) of the Code of Ordinances of the City of Sergeant Bluff, Iowa, addressing the Fire Chiefs duties is repealed and the following adopted in lieu thereof:

6.   Command. Be charged with the duty of maintaining the efficiency, discipline, and control of the Fire Department. The members of the Fire Department shall, at all times, be subject to the direction of the Fire Chief. In consultation with the City Administrator and the City Attorney, the Fire Chief may remove or terminate any person from their office or position in the department including but not limited to, Assistant Chiefs, Captains, Lieutenants, Firefighters, EMTs, paid on-call members, or volunteers.

SECTION 2.  REPEALER. All ordinances of parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. In all other respects, the Code of Ordinances City of Sergeant Bluff, Woodbury County, Iowa shall remain in effect.  

SECTION 3.  SEVERABILITY. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.  

SECTION 4.  EFFECTIVE DATE.  This ordinance shall be in effect from and after its final passage, approval, and publication as provided by law.
