ORDINANCE NO. 764
AN ORDINANCE AMENDING CHAPTERS 165B AND 165D OF THE ZONING CODE OF THE CITY OF SERGEANT BLUFF, WOODBURY COUNTY, IOWA
WHEREAS, the Planning and Zoning Commission of the City of Sergeant Bluff has recommended approval of amendments proposed by City Administration to the zoning ordinance; and
WHEREAS, following notice published pursuant to Iowa Code Sections 362.3 and 414.4, a public hearing was held during the Planning & Zoning meeting on the 3rd day of June 2025, at which parties in interest and citizens had an opportunity to be heard on the proposed changes; and
WHEREAS, following notice published pursuant to Iowa Code Sections 362.3 and 414.4, a public hearing was conducted at the City Council’s regular meeting on the 10th day of June 2025 at which parties in interest and citizens had an opportunity to be heard on the proposed changes; and
WHEREAS, the City Council has determined it is in the City’s best interest to approve the proposed changes in the Zoning Code applicable to Land Use Categories, RS150 Accessory Building Height, and Minimum Design Standards for Residential Structures; and
BE IT ORDAINED by the City Council of the City of Sergeant Bluff, Iowa, that:
SECTION 1. SECTION MODIFIED. Section 165B.09 – Land Use Categories Matrix of the Code of Ordinances of the City of Sergeant Bluff, Iowa, is repealed and the following adopted in lieu thereof:

SECTION 2. SUBSECTION MODIFIED. Subsection 165B.1(7) including the Height and Lot Requirements table for RS150: Single-Family Residential District of the Code of Ordinances of the City of Sergeant Bluff, Iowa, is repealed and the following adopted in lieu thereof:
SECTION 3. SUBSECTION MODIFIED. Subsection 165D.20(5) of the Minimum Design Standards for Residential Structures of the Code of Ordinances of the City of Sergeant Bluff, Iowa is repealed and the following adopted in lieu thereof:
5.Every new residential dwelling shall have a sidewalk extending across the front of the property and any side which abuts a street for a corner lot. Sidewalks shall be installed and maintained in accordance with the standards set forth in municipal code section 136.08.
SECTION 4. REPEALER. All ordinances of parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. In all other respects, the City of Sergeant Bluff Woodbury County, Iowa Zoning Ordinance including Chapters 165B and 165D shall remain in effect.
SECTION 5. SEVERABILITY. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
SECTION 6. EFFECTIVE DATE. This ordinance shall be in effect from and after its final passage, approval, and publication as provided by law.
