1.  MAYOR/MAYOR PRO-TEM TO CALL THE MEETING TO ORDER:

Ron Hanson was not present at the start of the meeting but arrived at 5:07pm
2.  APPROVAL OF THE AGENDA:
Motion by Carol Clark, seconded by Andrea Johnson to Approve the Agenda. Motion Carried. [Unanimous]
3. HEARING:
3.aHearing on Appeal of Order to Remove Vicious Dog(s) From the City - Owner Residing at 1620 Forsling
The hearing began at 5:00pm and ended at 6:12 pm
Jason Hahn, 1620 Forsling, presented his appeal to keep his dog(s). A single original copy of statements of support for the dogs was shared with the Council.
Police Officer George Horner described the events that led up to the order to remove the dog(s).
Robin Putterbaugh, 1602 Forsling, described what she witnessed when her dog was attacked.
Hahn was allowed the ability to provide a rebuttal.
The Mayor and City Council asked questions of all parties who presented, pertaining to the removal order, and reviewed the presented evidence.
The Mayor and City Council provided comments on the findings of the hearing.
4. DISCUSSION/ACTION ITEMS
4.aCouncil Decision to Either Affirm or Reverse the Order to Remove Vicious Dog(s) From The City - Owner Residing at 1620 Forsling
Motion by Ron Hanson, seconded Mark Reinders to reject the appeal in accordance with Ordinance Chapter 56.04 and to affirm the order directing them to remove the dogs.
  Motion Carried. [Unanimous]
Jason Hahn left the meeting then returned to request clarification on timing for the removal of the dogs from City limits. The Mayor stated that the ordinance requires three (3) days for removal and any variation of time must be approved by the Police Chief.
4.bORD 749 New Chapter 161 FLOODPLAIN MANAGEMENT (Third Reading)
Motion by Kirk Moriarty, seconded by Andrea Johnson to Approve ORD 749 New Chapter 161 FLOODPLAIN MANAGEMENT (Third Reading)
Motion Carried. [Unanimous]
4.cDiscussion and Potential Action to Rescind Previous Action Regarding the Gill Hauling Bid for 2024-2029 Residential Solid Waste Hauling
Aaron Lincoln explained that he proceeded based upon the input from the last Council Meeting. Gill Hauling negotiated in good faith, however garbage truck issues have occurred each time the new contract has been on the agenda, and the concern has been whether agreement language would sufficiently provide the needed level of service. If the Council is not desiring to continue with Gill Hauling as the next Contractor then they must rescind the prior action to award.
There was Council discussion regarding the events that led up to this potential action.
Motion by Kirk Moriarty, seconded by Carol Clark to Rescind Previous Action Regarding the Gill Hauling Bid for 2024-2029 Residential Solid Waste Hauling.
Motion Carried. [Unanimous]
4.dDiscussion and Potential Action on the Remaining Bids for the 2024-2029 Residential Solid Waste Hauling Services (Action may include pursuing interest in an existing bidder or awarding the contract to an existing bidder)
Based upon prior Council input, City staff went to the next bidder, Carrier Container Company, and discussed if an agreement could be reached before the new contract start date of October 1, 2024 in the event Council wanted to rescind the award to Gill. Aaron Lincoln reviewed the proposed changes to the agreement with Carrier Container Company compared to the agreement with Gill Hauling that was on the agenda for June 11th. The City Attorney has also reviewed the changes.
The Council discussed with Chad Carrier how his garbage service would operate in Sergeant Bluff.
Motion by Carol Clark, seconded by Kirk Moriarty to Award the Solid Waste Hauling Services agreement to Carrier Container Company.
Motion Carried. [Unanimous]
5. ADJOURNMENT:
Motion by Carol Clark, seconded by Kirk Moriarty to Adjourn at 6:52 pm. Motion Carried. [Unanimous]
